Hemphill, who was ten years old at the time of her death. Marine was later indicted by a grand jury for murder in the first
degree. Following a reverse amenability hearing, 2 he was prosecuted as an adult in Superior Court and found guilty by
a jury of murder in the second degree, and convicted and sentenced to life imprisonment. In his appeal, Marine raises four
